How the damage dispute process works
If a studio identifies damage to equipment or furnishings after your visit, they may file a damage report through the platform. Below you'll find a full description of the process and your rights.
1. Studio reports damage
After your session, the studio has 72 hours to file a damage report. The report includes:
- Description of damage
- Photos (before and after, if available)
- Estimated damage amount
2. You receive a deduction proposal
If the studio determines that compensation is needed, they'll propose a deduction from your deposit. You'll receive:
- An email about the proposal
- A notification in your account panel
- Access to all evidence presented by the studio
3. You review evidence and decide
In your panel (booking details) you'll see:
- Evidence photos
- Damage description and amount justification
- Studio notes
You have a specified time to respond (usually several days). You can:
- Accept the proposal - the amount will be deducted from your deposit on behalf of the studio
- Reject the proposal - providing a justification for your disagreement
4. If you reject the proposal
Your deposit will not be charged. The studio then has two options:
- Close the case without further action
- Submit the case for mediation by the Booquela team
5. Mediation by Booquela
If the studio escalates the case:
- The Booquela team reviews evidence from both parties
- Booquela mediates between you and the studio to find a resolution
- Booquela does not make unilateral decisions - it helps the parties reach an agreement
- Both parties have equal right to present their arguments
6. If mediation does not resolve the issue
You have the right to out-of-court consumer dispute resolution:
- The competent Provincial Trade Inspection (WIIH) is the authorized body
- A list of inspectorates is available at UOKiK
Your rights
- You have the right to reject any deduction proposal
- Your deposit is not charged automatically - it requires your explicit consent
- You have access to all evidence presented by the studio
- You have the right to mediation by Booquela
- You have the right to out-of-court dispute resolution (ADR)
The booking agreement is between you and the studio. Booquela provides tools for documentation, communication, and mediation, but is not a party to the damage dispute and does not resolve it unilaterally.
Before starting your session, check the equipment condition and take photos. If you have any concerns, report them immediately to the studio staff - this is the best protection against unfounded claims.
