Mediation for Studio Owners operating as businesses

Right to mediation

If you are a Studio Owner operating as a business (entrepreneur) based in the European Economic Area and you have submitted a complaint through Booquela's internal complaint handling system (in accordance with Section 25.1 of the Terms of Service), and the complaint was not resolved to your satisfaction, you have the right to use mediation.

The right to mediation arises from Article 12 of Regulation (EU) 2019/1150 (the P2B Regulation) on promoting fairness and transparency for business users of online intermediation services.

Available mediators

Below are the mediation bodies and institutions whose services you may use:

1. Mediation Centre at the Lewiatan Confederation

2. Mediation Centre at the Arbitration Court of the Polish Chamber of Commerce (KIG)

3. Mediation Centre of the Arbitration Court at the Polish Financial Supervision Authority (KNF)

4. Certified out-of-court dispute resolution body (ADR)

In accordance with Article 21 of Regulation (EU) 2022/2065 (Digital Services Act), you may also use a certified out-of-court dispute resolution body in your country.

How to use mediation

  1. Ensure you have first submitted a complaint through our internal system (contact: [email protected]).
  2. If the complaint was not resolved within 14 days or you are not satisfied with the resolution, you may contact the mediator of your choice.
  3. Inform Booquela of the initiation of mediation at [email protected]. Booquela undertakes to participate in mediation in good faith.

Mediation costs

Mediation costs depend on the chosen mediation body and are determined in accordance with its rules. Booquela covers a reasonable share of mediation costs in accordance with Article 12(4) of the P2B Regulation.
